
Border Czar Tom Homan has asked the Department of Justice to determine whether Rep. Alexandria Ocasio-Cortez (D-NY) violated federal law by advising illegal immigrants on how to avoid encounters with Immigration and Customs Enforcement (ICE). Homan reached out to the Deputy U.S. Attorney General to get an official ruling on whether her actions could be classified as obstruction.
Ocasio-Cortez’s webinar, titled “Know Your Rights With ICE,” was streamed live on her Facebook page and targeted illegal immigrants in her district. The event provided instructions on how to refuse ICE searches, avoid questioning, and seek legal assistance if detained.

Homan, who has long been a strong advocate for immigration enforcement, questioned whether Ocasio-Cortez’s guidance may have impeded federal law enforcement efforts. He stated that he was waiting for a DOJ determination on whether her involvement crossed legal boundaries.
Tom Homan has referred AOC to the DOJ for potential prosecution.

Ocasio-Cortez pushed back against the criticism, claiming that ICE agents have unlawfully entered homes without proper legal authority. She defended her event as a public service aimed at informing individuals of their rights and ensuring immigration enforcement follows legal procedures.

Legal experts note that providing general legal information is protected under the First Amendment, but directly aiding individuals in avoiding law enforcement could lead to legal scrutiny. The DOJ has not yet announced whether it will take action.
