During an event at the Supreme Court Historical Society, liberal filmmaker Lauren Windsor posed as a conservative to extract controversial statements from Alito. Despite Alito’s statements being moderate and factual, Rolling Stone framed them as scandalous.
Windsor deceitfully suggested to Alito that negotiating with the left was impossible and that the polarization in the country was a matter of winning or losing. Alito agreed that certain fundamental differences couldn’t be compromised. “One side or the other is going to win,” Alito said. “There are differences on fundamental things that really can’t be compromised.”
This straightforward acknowledgment of political realities was twisted by Rolling Stone to portray Alito negatively. The magazine expressed outrage over Alito’s agreement with Windsor’s fake conservative rhetoric about the importance of godliness in America. Rolling Stone’s article implied that it was inappropriate for a Supreme Court Justice to hold and express religious beliefs.

Moreover, Alito’s remarks about the limitations of the Supreme Court in resolving issues like the backlash against the Dobbs v. Jackson decision were also criticized. Alito pointed out that the court has a defined role and must operate within its boundaries. He reiterated that the court does not have law enforcement powers, emphasizing the constraints of judicial authority.
