Judge Denies Hunter Biden’s Motion To Dismiss Gun Case

On Friday, U.S. District Judge Maryellen Noreika rejected Hunter Biden’s motion to dismiss federal gun charges against him. Appointed by President Donald Trump, Judge Noreika rejected Biden’s claims that the prosecution was politically motivated. The trial in the case is set to begin on June 3.

The charges stem from Hunter Biden’s October 2018 purchase of a Colt Cobra 38SPL revolver. The first son was admittedly addicted to crack cocaine at the time he bought the gun. Special Counsel David Weiss has charged Biden for his alleged lies on a federal firearm purchase form on which he denied the use of illegal drugs.

Weiss has also filed court papers detailing physical evidence related to the gun involved in the case. Investigators discovered cocaine residue on and near the gun when it was found after having been thrown away in a dumpster.

Hunter’s attorneys argued that their client was being unfairly targeted due to his father’s political position, claiming the case resulted from political pressure from Republicans. Judge Noreika found these arguments utterly unconvincing and bordering on ridiculous.

In her order, Judge Noreika was particularly unimpressed by Hunter’s claims that he is somehow a “victim.” She wrote, “Defendant’s articulated protected class is apparently family members of politically-important persons.”

The order continued: “Defendant’s claim is effectively that his own father targeted him for being his son, a claim that is nonsensical under the facts here. Regardless of whether Congressional Republicans attempted to influence the Executive Branch, there is no evidence that they were successful in doing so and, in any event, the Executive Branch prosecuting Defendant was at all relevant times (and still is) headed by Defendant’s father.”

Weiss filed the current gun case against Hunter Biden last year after a proposed plea agreement that would have diverted the prosecution and kept the first son out of prison was derailed.

The order also denied requests from Hunter’s legal team to subpoena President Trump and former Attorney General Bill Barr to his trial. The judge found that Trump administration witnesses were irrelevant to the case, in that the Biden DOJ filed the gun case against Hunter.
Hunter Biden is defending a separate criminal case in a California federal court that includes three felony tax-related charges. In that case, he is accused of evading at least $1.4 million in federal taxes while enjoying an “extravagant lifestyle.”

The criminal charges facing Hunter Biden have drawn considerable attention in light of Joe Biden’s ongoing reelection campaign. As the Biden Department of Justice and the corrupt Fulton County, Georgia, District Attorney Fani Willis continue their efforts to prosecute President Trump before November to interfere with the presidential election directly, the Hunter Biden prosecutions are sure to detract from the Democrats’ lawfare.
