On Monday, the DOJ announced a lawsuit against two pro-life organizations, Citizens for a Pro Life Society and Red Rose Rescue, along with seven pro-life activists, for alleged violations of the Freedom of Access to Clinic Entrances (FACE) Act nearly three years ago.
The lawsuit alleges that the defendants engaged in physical obstruction at two Ohio abortion clinics in 2021. The incidents involved entering waiting rooms and urging pregnant women not to undergo abortions, leading to disruptions in clinic operations and police intervention.
Director of Citizens for a Pro-Life Society, Monica Miller, disputed the government’s claims, stating that their actions involved peaceful interaction and assistance to pregnant women.
Assistant Attorney General Kristen Clarke defended the DOJ’s actions, emphasizing their commitment to enforcing the FACE Act to protect access to reproductive health services. However, critics have pointed out the apparent selective enforcement of the law.
Under Clarke’s leadership, the DOJ has intensified enforcement of the FACE Act, primarily targeting pro-life activists. Meanwhile, instances of violence against pregnancy centers and churches have gone largely unpunished.

Republican lawmakers, including Sen. Mike Lee (R-UT) and Rep. Chip Roy (R-TX), have denounced the DOJ’s actions as part of a broader pattern of bias. They argue that while pro-life activists face legal action, criminals and left-wing rioters are given leniency.
🧵 1. The FACE Act criminalizes an odd assortment of offenses, including blocking access to and vandalizing (1) abortion clinics, (2) places of worship, and (3) pregnancy centers.
How many prosecutions has Team Biden brought in the second category?
Zero. Not even one. https://t.co/SbbYpGvh7P

Lee called for the repeal of the FACE Act, condemning its misuse against pro-life sidewalk counselors. Roy criticized the Biden administration’s approach to justice, accusing them of prioritizing political agendas over law enforcement.
In this Newsweek op-ed, @chiproytx and I argue for the repeal of the FACE Act, which “holds no value other than to allow Justice Department bureaucrats to carry out a radical pro-abortion agenda.”https://t.co/NXHHgZZIJi

The DOJ’s lawsuit has reignited debates over the government’s role in protecting freedom of speech and assembly, particularly in the context of contentious social issues like abortion.
